Confidential Business
9.Farm Business Tenancy tenders - delegated authority under Parish Council minute 26.150.05
i.To open and formally record all tenders received by the closing date for the Parish Council's agricultural land offered under the published letting particulars.
ii.To consider and evaluate the tenders, taking account of the published terms and the advice of the Council's land agent, and to select the successful tenderer or tenderers for the holding as a whole or for any combination of the individual lots.
iii.To award the five-year Farm Business Tenancies on the terms set out in the letting particulars, subject to any non-material amendments recommended by the Council's professional advisers and considered to be in the Parish Council's best interests.
iv.In respect of the land at Flaxmill Lane, to exercise the authority previously granted by the Parish Council to identify a preferred bidder and, in consultation with the Chair and Clerk, negotiate and agree an appropriately short or flexible Farm Business Tenancy so that the land remains maintained and income-producing without prejudicing the Council's consideration of the outstanding proposal.
v.To authorise the Clerk, in consultation with the Chair, to instruct the Council's land agent and legal advisers to prepare the resulting tenancy documentation, provided that any material departure from the published letting terms, substantial unbudgeted financial commitment or matter outside the authority delegated under minute 26.150.05 shall be referred to the Parish Council for approval.
10.To consider any confidential quotes.
